Operations:
Whilst we will endeavour to ensure that your website operates reliably, it may require periodic maintenance, updates and changes. These are not covered in our basic contract of service provision. However we do offer a support package that covers much of this.
Issues such as database corruption, user errors, and performance-related issues (as the amount of content the website manages increases) are all standard considerations for websites. However sometimes issues will emerge that we are unable to detect or predict through pre-operational testing.
We therefore advise all our customers to purchase one of our support packages. We also offer to use any unused hours on feature enhancements, maintenance and performance tweaking.
Support:
We offer a basic level of support to our customers. Within our fair use policy we offer to lend advice and assistance on a variety of issues.
However owing to the demands placed upon our core team this has to be prioritised. We therefore provide different levels of access to our support systems. With the greatest priority given to Premium Support customers.
Our turnaround time is typically 48 hours, and we commit to replying to you regarding the status of work, any emergent issues, payment required (if applicable), etc.
Hosting:
Dependent on our service contract with you, we offer a range of hosting packages. Because of the various technical differences between their operation please refer to the T&C for your specific hosting package.
Renewals for hosting must be made in the month preceding the expiry date (please refer to your invoice for this date).
Though ATE Design will attempt to inform you of the impending expiry date, but please be prompt with payment to ensure continuous operation. If payment is not received, we reserve the right to take your website offline. You may incur further costs for time to restore the website.
Late payments will accrue our standard fee of 10% per calendar month past the initial payment window, which, unless otherwise specified in our development contract, is 15 days after project completion.
General payments:
Payments and financing must be agreed upon in advance and in writing. Typically, 50% of the total quoted cost is due in advance. We will only release access and control of the website over to you once all outstanding balances have been cleared.
As mentioned above concerning hosting, late payments will accrue our standard fee of 10% per calendar month past the initial payment window, which, unless otherwise specified in our development contract, is 15 days after project completion.
ATE Design reserves the right to pass on outstanding unpaid bills to a third party debt collection agency. If this is necessary, you will be liable for any costs involved in the collection of unpaid payment.
Discounts and offers are subject to standard terms and conditions and must be agreed upon in advance by all parties in writing.
Copyright:
All names, copy, content, images, derivatives and visual or coding work produced by ATE Design is considered to be copyright ATE Design.
Until we have received payment in full and agreed in writing we reserve all copyrights. We reserve our right to refuse use of this work until all outstanding accounts are settled or permission is given in writing by ATE Design.
Design & Copyleft
All visual materials--including text, photographs, graphic design and other media resources (including video and audio)--are considered to be copyleft. Meaning that the work can be used again under the same copyright agreement, however deviation from this is not permitted (e.g. an image used for a website may be used in a print medium).
We take no responsibility for storing business assets. If upon agreement you require design files please contact us ahead of the conclusion of business to request these files. This may involve an additional charge depending on the time involved.
We reserve copyright over all materials until full payment has been received and written transference of copyright has been made from ATE Design to the client.
Third Party Imagery:
We will sometimes use third party imagery (referred to as stock imagery). Please be aware of any applicable rights uses and comply with all rights and obligations within these agreements. ATE Design takes no responsibility for the misuse of imagery that falls under rights or other related protection.
External suppliers:
While we advocate the use of third party applications and systems, we are not responsible for changes, modifications and updates that result in compatibility issues (e.g. changes to APIs such as Facebook that render any of our services inoperable).
Updates and issues such as these fall under our service and support contracts and may require consultation/written agreements in advance.
Work requests:
Work requests must all be committed and confirmed in writing by both parties before any work or service is undertaken. Work agreed outside of this context will not be considered as part of the project as originally quoted. Amendments must be agreed upon and signed by both parties. Work conducted outside of a written agreement may be subject to additional charges and fees, unless otherwise specified.
Trading names:
Alltooeasy is the brand name for ATE Design. ATE Design is the trading name for the partnership between J.Hunt and J.Tapsfield. All payments should be made out to ATE Design.
